Terms & Conditions for The Meet Market events participation
If you are a maker, (ie designer, artist, producer or collector), and want to exhibit your products at the The Meet Market (TMM) live events, you can express your interest here after reading and accepting the following terms and agreements, which regulate everything regarding your participation in the live events:
By accepting this, a binding agreement is concluded, which regulates the contractual relationship between the sole proprietorship with the name Alison Damianou, Promotion and Organization Services for Artistic and Cultural Events, based in Athens, at 12 Petraki Street, with VAT number 143526732, Tax Office A' Athens, who organizes the live events of The Meet Market and which hereinafter for the sake of brevity will be called "the Organizer" and the designer, artist, producer or collector (hereinafter "the Maker"), who wishes to participate in the live events (hereinafter "the events"), organized by the Organizer.
1. The participation of the Maker in each event is left to the discretion of the Organizer, who has the right to curate each event, to select the participants for each event as well as their placement in the space based on the available seats, the variety of products and the aesthetics of the layout of each event.
2. The cost of the Makers's participation in each event will be determined each time by the Organizer and will be calculated depending on the size of the space allocated to the Maker and may vary depending on the location and duration of each event. The size of the space allocated to the Maker by the Organizer under this contract and the relevant cost will be specified and will be listed in the relevant tax document to be issued by the Organizer.
3. After confirmation of the Maker's participation in a specific event, in order to secure his/her place, the Maker will pay 50% of the total amount in advance on a date to be determined by the Organizer each time. The remaining 50% will also be paid on a date to be determined by the Organizer and in any case before the event. In case the Maker maintains an active online store on the online platform www.themeetmarket.gr, he/she will enjoy a 10% discount per event. The Organizer is entitled to withhold the Maker of the right to a discount in case his store remains inactive for more than two months. In order to be granted the above discount, the Maker is required to have activated his/her store no later than the date set as the date of payment of the above-mentioned advance payment for the event for which his participation has been approved.
4. In the event of cancellation of the Maker's participation for reasons not related to the Organizer, this deposit will only be refunded if the cancellation is made known to the Organizer up to one (1) month before the event, otherwise it remains in the hands of the latter.
5. The Maker expressly declares and accepts that he/she maintains a legal business, the licenses and conditions required by law for the distribution of his/her products and that he/she bears full and exclusive responsibility towards the Law and/or any third party for the participation and sales he/sje will make in the context of the events, as well as for all supporting documents, such as receipts, invoices and in general documents that may be issued, the legal employment and insurance of the employees who will work on his/her behalf at his/her stand, expressly exempting the Organizer from any relevant liability and agreeing to fully compensate it in the event that the latter is found to be at fault for any issue concerning the above.
6. The Maker expressly declares that he/she bears the exclusive responsibility for his/her cash register, the obligation to use his/her own cash register as well as a wireless POS machine. In the event that he/she does not have his/her own wireless POS machine, he/she must declare to the Organizer that he/she wishes to use the POS of the event's central cash register. The cost of using the POS amounts to five percent (5%) of the Maker's total receipts.
7. The Maker is solely responsible for the good appearance and cleanliness of the space allocated to him/her at each event, the setting up of his/her stand at the beginning of the event, and the collection of all kinds of his/her own products at the end of the event, as well as for any damage, whether culpable or not, caused by his/her actions or omissions or those of his/her assistants to the space where the event takes place, to the tents, to the sides of the tents, to the Organizer, and/or to other participants or third parties (space, customers, etc.). Especially in the case of culpable or non-culpable damage, he/she accepts and undertakes to fully compensate the damage to the third party who invokes it as well as to fully compensate the Organizer for any expenses that he/she may incur in order to repair the damage himself/heself to the third party. He/she also bears exclusive responsibility for the care and presentation of his/her stand as well as for any equipment or objects he/she deems necessary for the setting up of his/her stand, e.g. additional lighting, rails, shelves, decoration, etc.
8. Following the designation and presentation of the space in which the Maker will place his/her stand and his/her products, the latter bears sole responsibility for the installation, security, storage and maintenance of any objects he/she has brought into the event venue (including equipment, decorations, raw materials, electronic devices, etc.). Upon delivery of the space, in which, at the Organizer's direction, the Maker will place his/her products, the Maker acknowledges and accepts that the Organizer will not be liable for any loss or damage to any products owned by the Maker or which is in the Maker's possession and which may be destroyed, worn out or lost in any way, as well as that the Maker bears full and exclusive responsibility for the proper use of the space and all types of objects and products that will be placed at his/her direction by third parties or his/her assistants, in compliance with the terms of this.
9. Although security personnel are provided at the event venue, the Organizer expressly disclaims any liability for any goods or other assets or goods of the Maker or assets of third parties located at the event venue and throughout the event and at any time, whether during or outside of operating hours.
10. The Maker accepts that any of the following acts or omissions will entitle the Organizer to expel him/her from the event, and establish his/her obligation to compensate the Organizer for any expenses he/she may incur in connection with the above behavior and to repair any damage or harm caused to the Organizer resulting from the Maker's following behavior:
a) violation of any term herein,
b) display or sale of stolen items,
c) loss of equipment provided by the Organizer and belonging to her, such as, for example, ladders, transport carts, power strips, lamps, etc.
d) aggressive or violent behavior during the events,
e) non-payment of the participation fee,
f) use of the name or logo of the event without the prior written approval of the Organizer or competition with the Organizer,
g) behavior or actions that are inconsistent with the purposes of the event, good morals and good faith.
11. In the event that the Maker:
a) designs or manufactures his own products (Artisans and Designers): all objects to be exhibited/sold must be of good quality and technique at the discretion of the Organizer. All products must show uniqueness in both design and manufacture. The Organizer wants to encourage creativity and imagination, so she does not put up barriers, as long as the objects are not offensive or dangerous. The handicrafts and products are expected to belong generally to the categories: jewelry, accessories, (mind, body and soul) care & wellness, decoration & art, children, pets, and tasting corner (packaged food goods).
b) sale of Used goods or Collectibles: the exhibits are prohibited from being products of illegal activity (stolen goods, etc.). The collectibles are expected to be of two categories: a) used clothes, shoes, hats and accessories, b) music: vinyl LPs, CDs, cassettes, music DVDs, all strictly non-pirated.
c) sale of food and beverages: all food, beverages and their packaging and preservation must fully comply with the public health conditions of the state and municipal authorities. These terms and conditions in combination with the above-mentioned document that the Organizer will issue before each event are binding on the parties and constitute their full agreement regarding what is regulated by them (documentation, these terms and conditions), and may be used by the Creator for tax purposes and for the legal transfer of his/her cash register and wireless POS machine, if he/her has them, to the specific location of the event.
12. These terms and conditions, in conjunction with the aforementioned tax document (invoice) that the Organizer will issue before each event, bind the parties and constitute their full agreement regarding what is regulated by them (documentation, these terms and conditions), and may be used by the Maker for tax purposes and for the legal transfer of his/her cash register and wireless POS machine, if he/she has them, to the specific location of the event.
13. The Maker accepts and agrees to be included and displayed in the “Makers” category on the Organizer’s official website (www.themeetmarket.gr). He/she expressly consents to the display of photographs of his/her products and information related to his/her commercial activity. More specifically, this information may concern: his/her professional email address, link to the Maker's official website, work phone number, the Maker's Facebook page, if any, and his/her profiles on the electronic platforms Twitter, Soundcloud, Instagram, Facebook, Tik Tok, Youtube and Vimeo, if any. The Maker accepts that the above data will be used by the Organizer in full compliance with the GDPR regulations of the European Union.
14. The Maker expressly consents to the photography of his/her space (with or without the intervention of persons) by the Organizer (by an authorized employee or associate of the Organizer) with or without a professional camera, and to the use of said photographs to promote the purposes of the event as well as for any reason deemed appropriate by the Organizer. Indicatively, the Maker: a) grants to the Organizer all intellectual property rights and the right to use, reuse, publish, and republish photographic portraits or photographs that may depict the Maker's legal representative(s) (in the event that it is a legal entity) and/or his works, which may include the image of his/her legal representative(s) or persons participating in the business in whole or in part, in combination or with a distorted character and/or form, without restrictions as to changes and/or transformations in combination with the name of his/her legal representative(s) or a fictitious name, or its reproduction in another color or manner, through any and all means media now existing or hereafter known for purposes of illustration, art, promotion, advertising, business/trade, or any other purpose, b) authorizes the use of any printed material in connection with the above, and c) waives any right related to the examination or approval of the final product or products or the advertising copy or the form that may be used in conjunction with this or for the use for which it may be intended.
15. This agreement is of indefinite duration and may be terminated without loss by either party in writing (either by e-mail from the above-stated e-mail address), expressly excluding the case referred to in paragraph 4 hereof.
a) If any of the Terms herein are held to be invalid or unenforceable, the validity or enforceability of the remaining Terms shall not be affected.
b) This Agreement shall be governed by Greek law. Any dispute or tort arising under or in connection with the Agreement, including any proceedings during enforcement or the taking of any injunctive relief, shall be subject to the exclusive jurisdiction of the Courts of Athens.
