The Meet Market, otherwise referred to as TMM, is an online marketplace which operates as a third party that provides an opportunity to makers to sell their products to customers and discover a virtual network of clients. What we actually do is provide the platform where connections between makers and customers can be created. We do not represent the maker or the customer and we are here to maintain a healthy and ethical virtual environment. We do not sell any goods on behalf of the makers. We are not performing transactions on behalf of the makers at any stage, nor are we involved in defining the pricing of maker’s products or the individual maker storefront policies and settings created such as shop policies, shipping & return policies, pricing, etc.
TMM does not control and is not liable or responsible for the quality, safety, lawfulness or availability of the products offered for sale by the makers on our website, the ability of the makers to complete a sale or the ability of buyers to complete a purchase. You agree therefore that you will not hold TMM and our affiliates and agents liable for any losses, damages, claims, liabilities, costs or expenses arising from any transaction, including any breach, partial performance or non-performance of the transaction by the other party.
By accessing and using our services you agree to be bound by these Terms of Use which will be hereafter referred to as “the Terms”. With the text you are going to read below we are establishing our ground rules for our interaction with you whether you are a maker, a customer or a visitor. By accepting our Terms you declare that you are aware of the rights and responsibilities set in this contract. By accepting the Terms, no relationship like agency, working relationship or partnership is established between you and TMM.
You may use our services only in compliance with these Terms of Use in a form of a legally binding contract and all applicable local and European Union legislation. By the term Services we mean every service including a simple visit through your browser or your mobile app in our website/platform. Unless you agree to our Terms we won’t be able to provide you any of our Services.
The Terms constitute a general guide which can help you be part of The Meet Market community in a lawful and acceptable way by all the parties involved. The Terms apply to everyone that visits our website and uses any of our services. Part of these are some more specific texts referred to as “policies” (i.e. Maker's Policy, Shopper's Policy, Privacy Policy, Cookie Policy) with which you also agree by accepting the Terms. Find out which policy is relevant to you depending on how you use our Services and have a closer look.
The Terms may change from time to time. We will keep you up-to-date regarding any change and/or amendment we believe is crucial. The changes will be effective upon their posting unless otherwise specified. By using our services following the changes already posted we deem that you have run through the updated terms and have already accepted them.
By using our services we grant you the right to post your content, share your ideas and thoughts with the other members of TMM community. It is your content and we herein refer to that as such since you retain full ownership, but by posting it you grant us the permission to use it in order to help the community thrive and expand. We will use your content without infringing any right you own upon it. For example we may use your content for promotional reasons that could also include promoting your listings in our website, in TMM application or in our related sites on our Social Media (Facebook / Instagram etc) or on websites, applications, and social media pages of our partners or third-parties or on any advertising medium. By accepting the Terms you agree and acknowledge the above use of your Content. We may also remove your content in case we in our sole judgment believe that it violates the law or the Terms. Apart from the above, we have to inform you that there are many things that other users may also want to do with your content, for example copy it, modify it, re-share it or broadcast it. TMM does not bare any responsibility regarding that activity.
Legally explained you agree to grant us a worldwide, non-exclusive, irrevocable, transferable, perpetual, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, edit, translate, make derivatives, display and distribute your content in connection with providing our service to you and other users according to without owing any compensation to you. Providing you our services may also require modification and/or adaptation of your content in order to transmit, display or distribute it over computer networks and platforms, various social media and/or make changes in order to adapt your content to any limitations and/or requirements of devices, networks, media or services, which you also allow us to perform by accepting these Terms.
What you are not supposed to post
There are some things that we do not want to be distributed through our community and we truly believe that you will understand that you may not post through TMM e-shop; you agree not to post content that may contain any information or content that we deem to be unlawful, offensive, harmful, abusive, racially or ethnically offensive, defamatory, infringing, harassing, humiliating to other people, threatening, false and misleading or use our Services in a fraudulent or deceptive way or violating rights of any kind, including without limitation intellectual property rights.
We reserve the right to eliminate, reject and/or remove any of your content that we believe, in our sole discretion, violates these Terms.
In order to use some of our services you will need to create a personal account. To create a personal account you need to be older than 18 years old. Here you will find some rules that you need to pay attention to regarding your use of your TMM account.
The only person responsible for your account is you. Furthermore, you are responsible for any account that your financial data (ie. credit card info) is connected to.
When creating your account we consider you to be honest with us providing us with accurate information about yourself. It is prohibited to use false information or to infringe another person’s identity by using their personal data as yours or misrepresent your affiliation with another person or entity in a manner that intends to mislead, confuse or deceive others.
You may never use another user’s account without permission.
Username and password
When choosing your username make sure that it is not offensive, infringing anyone’s intellectual property rights and is not violating in any way these Terms.
Keeping your account safe is one more responsibility exclusively yours. We encourage you to use strong passwords and safeguard them and keep them secret. We can’t and we won’t be liable for any loss or damage arising from your failure to comply with the above requirements. In case of any breach of security or unauthorized use of your account, you must notify us immediately.
TMM is trusted by its users and we also need to trust you when using our Services. So make sure that you are using our Services and the licenses that we have granted you with responsibility and that you are not misusing them. Here are a few examples of things that you must not do and/or even attempt to:
a. Use our services for any unlawful purpose or for promotion of any legal activity;
b. Post any content that violates any applicable local, state, federal or international law that apply to you including among others any state intellectual property law, civil and/or criminal law or any contractual obligation;
c. Publish or link to malicious content, distribute viruses or other harmful computer code that could lead to any damage of another user’s browser or computer system, could disrupt our services or compromise any user’s privacy;
d. Try to reach non public areas of our services or our computer systems for whatever reason
e. Send unsolicited communications, promotions, advertisements or spam e-mails.
f. For any commercial purpose, except as expressly permitted under these Terms
In case you violate or in case we have reasonable suspicion that you have violated any of the above rules, we reserve the right to investigate and/or suspend your account, and/or permanently terminate your rights to use our online TMM services, remove or edit content or cancel order in our sole discretion. Furthermore, we reserve the right to immediately terminate your account without prior notice in the event that in our sole absolute judgment you violate these Terms or abuse the use of our service.
TMM is partnering with Everypay which is a licensed payment provider to facilitate card payments and other payments, the disbursement of funds to the makers, fraud analysis, identity verifications, etc.
Recognizing the importance of electronic payment security, EveryPay is a licensed Payment Institution by the Bank of Greece (Decision No. 280/3 / 23-7-2018 GG B 3010 / 25-7-2018), and manages securely card payment transactions, in accordance with the regulatory framework of the card transaction security management standard. Everypay is certified in accordance with the PCI DSS compliance standards. All Everypay services are made through secure connections with 256bit SSL certificates. EveryPay also supports the ability to use the 3D Secure service, an additional security token for VISA & MasterCard. The Payer then has to enter his personal secret code to complete the transaction successfully.
With Everypay, we share the makers’ and customers’ personal data that is absolutely necessary for the payments processing. By using our services and making a transaction through our platform you are accepting and complying with the terms of use and services of Everypay which you can find in the following link https://www.everypay.gr/terms-and-conditions/.
Our Privacy Policy describes how TMM deals with your personal data collected while providing our services to you. The types of personal data collected, the methods of collection and processing, the legal bases of the processing, the reasons of the processing and other important information can be found described in detail in our Privacy Policy which we recommend that you read carefully since it is inextricable part of these Terms, which means that by accepting them you are also accepting our Privacy Policy.
In case you want to exercise any of your rights mentioned in our Privacy Policy and acquire information regarding your personal data, you shall submit your request by sending an e-mail from the e-mail address you have used to register to our e-mail address [email protected] including your full name and telephone number for the purposes of verification of your identity.
For the enhancement of our services we also use the so called Cookie files. Their functionality and more details about their purpose and use can be found in our Cookie Policy which also is inextricable part of the Terms.
Your personal data (for example your name, e-mail address, shipping address) are processed by TMM, by the makers whose items you are buying and by our partners (i.e. Everypay). Each maker and each third party is considered a separate and independent data controller of your personal information according to the EU law. That means that each party is responsible for the personal information it processes while providing the services. For example, if a maker accidentally discloses a customer’s name and email address when fulfilling another customer’s order, the maker will be solely responsible for that unauthorized disclosure and not TMM.
Breaching the terms of use or using your account to conduct fraudulent or illegal activity
As clearly stated above we reserve the right to terminate or suspend your account in TMM e-shop as well as any other account related to you in our sole judgment. In case there is a report or it seems that you have violated these Terms or any other of our policies TMM has the right to suspend your account and investigate the case. During that time you will not be able to use any of the services we provide through our website or our mobile app or any other platform (e.g. creating accounts, buying, selling). After investigating your case TMM will inform you regarding the reactivation or the permanent deactivation of your account.
Extended account inactivity
We may also reserve the right to deactivate your account in case your account has remained inactive for at least 10 months.
Termination upon your request
You may also want to terminate your account and you are free to do it for whatever reason and any time through your Privacy Settings. You may check what happens with your personal data when you are closing your account in our Privacy Policy which constitutes part of these Terms.
Either by termination by TMM or by termination upon your choice once you have used our Services:
i) you remain bound to Terms even after your access to our Services has been terminated,
ii) you shall pay any outstanding bills and
iii) shall fulfill in general any obligation stemming out from your prior use of our services.
Use of data upon termination
In the case of termination of your account under any circumstances TMM will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in our Privacy Policy.
All content in or on our services, whether publicly posted in our website/mobile application etc or privately transmitted by users, is the sole responsibility of the person who created such content. TMM is not liable in any way for any content that you may find, or any loss or damage incurred as a result of the use of content found in our Services. That means that you are using our Services and relying on any truthfulness, reliability, completeness, accuracy of any content or material posted via our services and platforms at your own risk.
Likewise you agree that you are responsible for the content that you post as well as the consequences thereof, including the use of your content by third parties or other users of our services.
Our trademarks, brand identity, logos, graphics and everything that distinguishes our services is protected by the intellectual property laws of European Union and the national legislation. We would like you to spread the word and let the people know that you are a member of TMM community, especially when you sell through our platform, but with respect to the fact that you do not own any of our marks and indicators thus you cannot modify them or use similar logos, graphics, words etc as yours and to the specific relationship you have established with TMM depending on the way you use our services.
You may not use any of our names, logos, designs, indicators, trademarks etc in an unlawful, misleading, defamatory way or in any way that is anyway objectionable to us.
We respect the intellectual property rights of others and expect users of our Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.
If you believe that your Content has been copied in a way that constitutes copyright infringement, please provide us with the following information:
(i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
(ii) identification of the copyrighted work claimed to have been infringed;
(iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
(iv) your contact information, including your address, telephone number, and an email address;
(v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
We reserve the right to remove Content alleged to be infringing without prior notice and at our sole discretion. In appropriate circumstances, we may also terminate a user’s account if the user is determined to be a repeat infringer. Makers and customers accessing or using our website and our services shall assume the risks of conducting any purchase and sale transactions through our platform. Examples of such risks shall include, but are not limited to, misrepresentation of products and services, fraudulent schemes, unsatisfactory product quality, failure to meet specifications, defective or dangerous products, unlawful products, delay or default in delivery or payment, cost miscalculations, breach of warranty, breach of contract, transportation accidents, the risk that the manufacture, importation, export, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Sites may violate or may be asserted to violate Third Party Rights, and the risk that Users may incur costs of defense or other costs in connection with third parties assertion of Third Party Rights, or in connection with any claims by any party that they are entitled to defense or indemnification in relation to the assertion of rights, demands or claims by claimants of Third Party Rights. Examples of such risks also include the risk of claims from consumers, other purchasers, end-users of products or other third parties that they have suffered injuries or harm from their use of the products obtained through the Sites or Services. Taking into account all the above TMM is not liable or responsible for any damages, claims, liabilities, costs, harm, inconveniences, business disruptions or expenditures of any kind that may arise a result of or in connection with any of the risks mentioned above.
We are trying our best to provide you with our services at a high standard level analogous to our expectations. Keep in mind that our services are provided on an “as is” and “as available” basis without warranties of any kind whether express or implied including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We also reserve the right to change, suspend or discontinue any of the services at any time and at our sole discretion. We will not be liable to you for the effect that any changes to the services my have on you, including your income or your ability to generate revenue through our services.
TMM makes no warranty or representation and disclaims all responsibility and liability for:
(i) the completeness, accuracy, availability, timeliness, security or reliability of the services or any content;
(ii) any harm to your computer system, loss of data, or other harm that results from your access to or use of the services or any content;
(iii) the deletion of, or the failure to store or to transmit, any content and other communications maintained by the services; and
(iv) whether the services will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from TMM or through our services, will create any warranty or representation not expressly made herein.
Since we are based in Athens all disputes that may arise between you and TMM and may lead to legal action shall be filed and handled by the Court of Athens and the applicable law is the Greek law.
In case a dispute arises between you and any member of our community and/or user of our Services regarding or stemming from our Services as a result of violation of these Terms, we do not bare any responsibility since you are the one who is solely responsible for pursuing your legal rights and we encourage you to contact the other party and try to resolve the dispute amicably. In case any claims, demands or damages arise between you and other members or users of our services or other parties regarding our Services, you agree that TMM is absolved of any obligations to all of the above.
In case we are being sued because of something that you have done, you agree to defend and indemnify TMM (including any of our employees) and you guarantee that you will hold us harmless from any legal claim and/or demand that may arise from your actions, your use or misuse of our Services.
